Terms of Service

These terms apply to your use of BSR Spy (the “Service”) at bsrspy.ai, which is operated by HOGUE WEB SOLUTIONS LLC, a Virginia limited liability company (“we”, “us” or “our”). By creating an account or using the Service you agree to them. If you don’t agree, please don’t use the Service.

1. What the Service is

BSR Spy is a research tool for sellers of print-on-demand apparel. It shows publicly available product information about Amazon listings — such as price, rating, publication date and Best Sellers Rank — together with estimates, groupings and trend signals that we calculate from it.

2. Estimates are not facts

Amazon does not publish unit sales. Every “estimated sales” figure, trend arrow, theme and “rising demand” marker is a model-based estimate or inference. It can be wrong, and it is provided for research only. We do not promise that any design, niche or product will sell, and you are responsible for your own business decisions.

3. Trademarks and intellectual property

We hide listings from many well-known brands, franchises, artists and sports teams by default. That filter is a convenience, not legal advice, and it is not exhaustive. Whether a design infringes someone’s rights is for you to assess before you publish or sell it. BSR Spy does not clear designs for use.

4. Your account

• You must be at least 18 years old to create an account and subscribe.
• You sign in with a one-time code sent to your email address. Keep your mailbox secure.
• An account is for one person. Only one active session is allowed at a time, and sharing access is not permitted.
• You are responsible for activity under your account.

5. Subscriptions, trials and cancellation

• Plans are billed monthly or annually in US dollars at the price shown when you subscribe. Payments are processed by Stripe; we never see or store your full card details.
• Automatic renewal: monthly and annual subscriptions renew automatically at the end of each billing cycle, at the then-current rate, unless you cancel before the renewal date.
• A free trial, where offered, converts to a paid subscription at its end unless you cancel first. We send a reminder email shortly before that happens.
• You can cancel at any time from the Billing page. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then.
• Fees already paid are not refundable except where the law requires it.
• We may change prices with reasonable notice; a change applies from your next billing period.

6. Acceptable use

You agree not to:

• copy, scrape or systematically extract the Service’s data, or resell or redistribute it;
• attempt to interfere with, overload or gain unauthorized access to the Service;
• use the Service to build a competing product, or in breach of any law or third-party rights.

7. Our content and third-party data

The Service, its design and the estimates it produces belong to us. Product data originates from Amazon and is supplied to us by third-party providers; product images and names belong to their respective owners. We are not affiliated with or endorsed by Amazon.

8. Availability

We work to keep the Service available and its data current, but we don’t guarantee uninterrupted access or that every listing is up to date. Data for lower-ranked listings is refreshed less often than for top sellers.

9. Warranties, liability and indemnity

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or decisions made using the Service, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.

You agree to indemnify and hold us harmless from any third-party claims, damages and legal fees arising from your breach of these terms, your business decisions, or any claim that products you publish or sell infringe someone’s intellectual property rights.

10. Ending your use

You may stop using the Service at any time. We may suspend or end access if these terms are broken or to protect the Service.

11. Changes

We may update these terms. If a change is material we will tell you by email or in the Service; continuing to use the Service afterwards means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law principles. Any dispute arising from these terms or the Service will be resolved exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.

No class actions: to the extent the law allows, you waive any right to bring or take part in a class, collective or representative action against us, and may bring claims only in your individual capacity.
